Scope of application
The following General Terms and Conditions apply to all contracts that a consumer (hereinafter “Customer”) concludes with AVG GmbH for the goods and/or services presented in the online store. A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. We do not recognize deviating conditions unless we expressly agree to their validity.

Conclusion of contract
By clicking the “BUY NOW” button, the customer places a binding order which constitutes a contractual offer. Before submitting his order, the customer has the opportunity to check and, if necessary, change the data he has entered under the heading “Last check”. After sending the order, an e-mail is sent to the customer confirming receipt of the order and listing its details. This order confirmation does not constitute acceptance in the sense of sales law, but is only intended to inform our customers that their order has been received by AVG GmbH. The purchase contract is only concluded when the ordered goods are dispatched. The contract is concluded and processed in German. AVG GmbH reserves the right not to provide the promised service and to refund the purchase price to our customers if the goods are not available or temporarily unavailable despite the prior conclusion of a corresponding purchase contract.

Pricing
All prices quoted for consumers include the legally applicable value added tax. The prices valid on the day of the order in the webshop apply. With the release of a new version of the webshop, all previous price information becomes invalid.

Retention of title
The goods shall remain the property of AVG GmbH until final payment of the purchase price.

Liability
If the goods are defective, the statutory provisions on liability for defects shall apply. AVG GmbH accepts no liability for damages resulting from incomplete, late or non-delivery if these are caused by fire, strikes, lock-outs, force majeure or other circumstances beyond our control. In the event of non-delivery or delayed delivery by upstream suppliers, the AVG Group shall be entitled to withdraw from the contract with the customer. AVG GmbH undertakes to inform the customer immediately of the non-availability and to reimburse the customer immediately. In the event of damage caused by AVG GmbH, liability for slight negligence is excluded. This does not apply to injury to life, limb or health, the breach of cardinal obligations, i.e. obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer regularly relies and may rely, for guarantees or if claims under the Product Liability Act are affected. This also applies to the actions of our legal representatives, employees or vicarious agents. Liability in the event of a breach of material contractual obligations shall be limited to the foreseeable, typically occurring damage. The statutory claims of our customers are not waived by the above limitations of liability.

Effectiveness of the terms and conditions
Should one or more points of these terms and conditions be or become ineffective, this shall not affect the effectiveness of the remaining points and the effectiveness of the contract as a whole. The invalid provision shall be replaced by a provision whose effect comes as close as possible to the economic objective pursued by the contracting parties with the invalid provision. § 139 BGB is excluded.

Privacy policy
The customer is informed in detail about the type, scope, location and purpose of the collection, processing and use of the personal data required for the execution of orders, the registration for the e-mail notification service, by AVG GmbH via this link to the data protection about the content of the data protection. The customer expressly agrees to this collection, processing and use of personal data. He can revoke his consent at any time with effect for the future.
